A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 2012, the Defendant came to know of the Victim D (AF) E, which is the 10th anniversary of the Defendant’s entry into China, and came to know of the Victim D (AF). In order to play the cryp “Stop”, the Defendant became aware of the Victim, who was his son and female, at the home of E.

1. 피고인은 2013. 2. 12. 18:30~19:00경 거제시 F상가 316호에 있는 E 및 피해자의 주거지 옷 방에 들어가, 피해자가 친오빠 G이 게임을 하는 것을 구경하느라 몸을 앞으로 숙이고 있어 상의 사이로 피해자의 가슴이 보이자 순간적으로 욕정이 생겨 피해자와 그 오빠 G 사이를 가로막고 앉아 피해자의 상의 안으로 손을 집어넣어 피해자의 가슴 부분을 밀어 피해자를 뒤로 기대어 눕게 한 뒤, 피해자의 젖가슴을 손으로 주무르듯 만지고 피해자의 젖꼭지를 엄지손가락으로 쓰다듬었다.

2. 피고인은 2013. 2. 13. 18:30~19:00경 제1항 기재 장소에서, 피해자가 오빠인 G과 둘이만 있는 것을 보고 욕정이 생겨 전날과 같이 다시 피해자를 추행하기로 마음먹고 위 옷 방으로 들어가 피해자와 G 사이를 가로막고 앉아 피해자를 뒤로 밀어 눕게 한 다음, 피해자의 상의 안으로 손을 넣어 피해자의 양쪽 젖가슴을 번갈아 주무르면서 엄지손가락으로 피해자의 젖꼭지를 만졌다.

이에 피해자가 ‘하지 마세요’라고 하였으나 피고인은 ‘쉿, 조용히 해라’라고 하여 반항하지 못하게 한 뒤, 피해자의 젖가슴, 음부, 엉덩이 및 항문 부분을 제1항과 같은 방법으로 수회 만졌다.

Accordingly, the defendant committed an indecent act against the victim under 13 years of age.
