A defendant shall be punished by imprisonment for not less than one year and six months.
761,000 won shall be additionally collected from the defendant.
The additional collection charge shall be equivalent to the above additional collection charge.
Reasons
Punishment of the crime
[Criminal Power] On June 22, 2017, the Defendant was sentenced to imprisonment with prison labor for one year and two months for a violation of the Act on the Control of Narcotics, Etc. at the Jung-gu District Court on June 22, 2017, and completed the enforcement of the said sentence in a medical prison on August 21, 2017.
【Criminal Facts】
Despite the fact that the Defendant is not a narcotics handler, the Defendant handled psychotropic drugs-related Mesofts (one philopon; hereinafter “philopon”), as follows:
1. Trading of philophones and giving or receiving them;
A. At around 02:50 on May 1, 2018, the Defendant received philophones from C in a way that he/she receives philophones in a way that he/she receives philophones from C free of charge ( approximately 2 partitionss for a disposable injection).
B. At around 13:30 on August 4, 2018, the Defendant: (a) installed a key air-conditioner in the market value at the home located in Macheon-si D; and (b) purchased and sold 0.7g of philopon in a way that philopon was collected in return.
C. Around September 12, 2019, the Defendant traded 300,000 won to the winners of name cards (one name “F”; hereinafter “F”) at the 3rd floor of Jung-gu Incheon, Jung-gu, Incheon, and a philopon by receiving approximately 0.7 ghon from F.m.
2. Medication of phiphones.
A. At around 20:00 on May 2, 2018, the Defendant administered philophones in a way that scopons (two partitions for a disposable injection) received from H offices located in Ansan-si G in Ansan-si, as set forth in paragraph 1(a).
B. On August 5, 2018, at around 20:00 (a), the Defendant administered 0.35g of philophones purchased as set forth in paragraph 1(b) at the same place as that of paragraph (1).
C. On September 20, 2019, at around 21:00, the Defendant administered 0.35g of philophones purchased in the same place as Paragraph 1(c) by a method of sending them to coffee.
