1. The Defendants jointly share KRW 25,400,000 with respect to the Plaintiff as well as KRW 2.5 million from May 14, 2015 to the date of full payment.

Comprehensively taking account of the overall purport of the pleadings as to the statement in Gap evidence No. 1, Defendant B borrowed 2.5% (750,000 won per month) interest on January 28, 2013 and KRW 30 million from the plaintiff on January 27, 2014. Defendant C guaranteed the above loan obligation against the plaintiff on the same day. The defendants did not pay principal and interest from August 28, 2013, and the defendants paid KRW 20 million to the plaintiff on May 13, 2015.

The amount of KRW 20 million paid by the Defendants to the Plaintiff was appropriated for KRW 15,40,000 (=30 million + 0.0 million x 0.025 x (2016/30)) and KRW 4.6 million out of the principal amount, respectively, from August 28, 2013 to May 13, 2015; and KRW 15,400,00 for 16 months to 16.4 million.

Therefore, the Defendants are jointly obligated to pay to the Plaintiff 25 million won (=30 million won - 4.6 million won) and damages for delay calculated at the rate of 2.5% per month pursuant to the agreement from May 14, 2015 to the date of full payment. Thus, the Plaintiff’s claim of this case is justified within the scope of the above recognition, and the remainder of the claim is dismissed as it is without merit. It is so decided as per Disposition.
