1. The defendant shall pay 421,078,50 won to the plaintiff and 20% per annum from October 1, 2010 to the day of complete payment.

1. Indication of claim;

A. A. Around September 2008, the Plaintiff entered into a construction contract with the representative director D of Nonparty C, a telegraph of the Defendant Company, for the construction cost of KRW 342,583,500 with respect to the buildings listed in the separate sheet owned by the Defendant Company C (hereinafter “instant building”). Around that time, the Plaintiff entered into a construction contract with the 342,583,500 won for the construction cost, and around that time, up to January 201, the second floor and wall of the instant building, the 3rd floor and wall soup toilets and wall of the instant building, the 4th floor and wall soup, the second floor and wall of the instant building, the stairs and wall of the 1 to 6th floor, the elevator wall, the external

Since then, the Defendant Company, which received a successful bid for the instant building at auction, succeeded to the obligation to pay for the primary stone construction works from C Co., Ltd.

C. Since then, the Plaintiff requested additional construction from the Defendant Company, and completed construction work equivalent to KRW 109,895,000 in total for construction cost, such as elevator 240 square meters, parking 109 square meters, 109 square meters in parking studs, and the wall surface of the first floor and floor part, stone construction and studs construction in front of the building, construction in front of the building, and installation of stairs.

From March 16, 2010 to April 30, 2010, Defendant Company paid the Plaintiff KRW 31,40,000 as the price for the secondary stone construction in the instant case.

Therefore, the Defendant Company is obligated to pay the Plaintiff the total construction cost of KRW 421,078,50 (i.e., KRW 342,583,500 for the primary stone construction cost of KRW 109,895,00 for the secondary stone construction cost of KRW 34,100 for the secondary stone construction cost of KRW 34,10,000) and the delay damages calculated at the rate of 20% per annum as claimed by the Plaintiff from October 1, 2010 to the date of full payment.
