1. The lawsuit on the part of the claim for damages which the school invitation in the lawsuit in this case shall be dismissed.

2. The defendant shall make the plaintiff 14.

1. Basic facts

A. Status 1) The Defendant changed the name of C University from D University to C University.

hereinafter referred to as “C University” only

(2) On March 1, 1998, the Plaintiff was appointed as C University mechanical education and full-time instructors. On April 1, 2001, the Plaintiff was promoted as an associate professor in the Information and Automation engineering department, on April 1, 2005, as a technical education and associate professor, and on January 2, 2007, as a cultural education department, and as a teachers’ college member on December 1, 2009, respectively.

However, since a person who majored in education was newly appointed to C University, the Plaintiff provided lectures and guidance to the teachers, the general course of selecting teachers, and graduate students.

B. Around January 5, 2011, the Plaintiff applied for promotion of professors from March 1, 201 to the Defendant. However, as a result of the Plaintiff’s examination of promotion of achievements from April 1, 2005 to December 30, 201, the Defendant excluded the Plaintiff from those eligible for promotion (hereinafter “the first decision to be excluded from promotion”).

(2) After that, on July 11, 2012, the Plaintiff applied again for the promotion of professors as of September 1, 2012 to the Defendant.

However, the Defendant excluded the Plaintiff from the scope of promotion examination on the Plaintiff’s achievements from April 1, 2005 to June 20, 2012.

(hereinafter referred to as "the second exclusion from promotion").

On August 31, 201, 201, after the decision of exclusion from the first promotion, the Plaintiff filed an application for re-election with the Defendant on April 13, 201. However, on June 29, 201, the Defendant notified the Plaintiff of the disposition of refusal of re-election on the ground that “the education area and research area were met with the base point as a result of the evaluation of re-election against the Plaintiff, but the student guidance area was less than 41.75 points below the base point,” the Plaintiff’s revocation of the said disposition of refusal on July 22, 2011.
