Defendant shall be punished by imprisonment for a period of two years and six months and by a fine of three thousand won.

The defendant does not pay the above fine.

Punishment of the crime

On July 26, 2012, the Defendant was sentenced to five years of imprisonment with prison labor, 20 years of attachment of an electronic tracking device and matters to be observed, etc. on July 26, 2012, “the prohibition of outing out of a residential area during the period of attachment of an electronic device from 00:0 to 04:00 each day during the period of attachment of an electronic device,” and the execution of the sentence was completed on May 8, 2017, and an order to attach an electronic tracking device was commenced from May 11, 2017.

1. A person who has installed an electronic device in violation of his/her duty to maintain the utility of the electronic device shall not arbitrarily separate the electronic device from his/her body during the period of attachment of the electronic device, damage, interfere with its propagation, alter data received, or otherwise impair its utility;

Nevertheless, the Defendant, between around 17:46 on June 3, 2017 and around 18:46 on the ground that he was prone from around 17:46 to around 18:6, the Defendant went out without possessing a portable tracking device for about 60 minutes and violated the obligation to maintain the utility of the electronic device from that time, and thereafter violated the obligation to maintain the utility of the electronic device.

7. From around 08:49 to 11:08, the Defendant went out without possessing a portable tracking device at least six times in total as set out in [Attachment Table Nos. 1 to 6] and violated the obligation to maintain the utility of the electronic device.

2. Notwithstanding the above duty of restriction on outing out at night, etc., the Defendant violated the duty of restriction on outing out of a specific time zone, such as night, from that time to that time, the Defendant violated the duty of restriction on outing out of a trade name at around 00:01 on June 7, 2017 to 00:05, Seoul Dongdaemun-gu Seoul Building D with the land at around 00:05, thereby violating the duty of restriction on outing in a trade name

8. From 12. 12. 00:03 to 02:10, up to 7:14, the obligation to restrict going out during a specific time period, such as night time, was violated by the sequence 7 to 14 of the List of Crimes.

3. Obstruction of business;

A. On August 2, 2017, the Defendant: (a) around 18:30 on August 2, 2017, at the store run by the front victim F (n, 72 years of age) of Dongdaemun-gu Seoul, Dongdaemun-gu; and (b) performed funeral services following the above store by the victimized person.
