1. Defendant Busan Metropolitan City, Q, R, S, T, U, and V shall each be KRW 149,49,497,544, and KRW 3,00,000,00 for Plaintiff C.
Reasons
1. Basic facts
A. On May 5, 2012, around 20:52, a fire (hereinafter “instant fire”) occurred inside the entertainment tavern “X” (hereinafter “instant main store”) located within the 3th floor (area 559.41m2, a total floor area of 3,987m23m2, hereinafter “instant building”) of the 2nd underground floor located in Busan Jin-gu, Busan and the 6nd ground-based building (hereinafter “instant building”).
B. Defendant Q and R are co-owners who own each share of 4/5, 1/5, 1/5 of the instant building and the site thereof, and Defendant S, T, U, and V leased 3 floors above the above building from Defendant Q to operate the main points of this case.
[Around June 2009, U and V invested approximately KRW 225 million in each of them, and around June 2009, upon obtaining permission to change the use of the third floor above the above third floor from the Busan Jin-gu Office to amusement facilities (e.g., amusement taverns) in the second class neighborhood living facilities, and began to operate the main shop of this case from July 2009 on the ground that Defendant S was the president of the business, and Defendant S was working at the main shop from around June 2010. From around June 2010 to around June 2010, Defendant S only invested KRW 30 million in the business license from Defendant S and reported the succession of the business status to the Busan Jin-gu Office and operated the said main shop until the fire of this case until the time of the fire of this case].
On June 2009, the main point of this case is as follows: 24 room at the time of permission for change of use as amusement facilities; 3 emergency exit (emergency exit adjacent to the main office statistical group connected to the indoor office statistics group; emergency exit adjacent to the main office entrance connected to the outdoor office statistics group; and the main entrance and exit; and the attached room located adjacent to the main entrance and exit (the wall of the attached office is composed of noncombustible materials; the wall of the attached office is made up of incombustible materials; the door is composed of a door with a heat, a exhaustr, a smoke, and the door is cut off after the fire of this case; in fact, the above attached room was relatively clean without any damage.
