A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
The Defendant, along with Chokin C (C's birth), provided money as security to financial institutions in the Gyeonggi-si in the name of D D', E- 10909 square meters of forest land in the name of D', and conspired to repay personal debts or to use it for real estate auction business.
1. On June 8, 2009, the Defendant forged private document: (a) at the G association office located in Sanandong-gu, Manan-gu, Manan-gu; (b) the Defendant made the said C enter “D” in his/her own column, “D’s 107 Dong 1904” in his/her address column, “Seomun-gu H building 107 Dong 1904” in his/her address column, “general loan” in the loan section column, “350,000 million won; (c) on the starting date of the loan; (d) on June 11, 2009; (d) on the date of the expiration date of the loan period, “V (V)” in the fixed column, such as interest rate, etc., “V (V)” by the expiration date of the loan period; and (d) the obligor’s consent to provide his/her personal credit information in his/her name and/her name “200D” in advance.
Accordingly, the Defendant, in collusion with C, forged one copy of the loan transaction agreement in the name of D, a private document on rights and obligations for the purpose of uttering.
2. The Defendant’s uttering of the above investigation document in collusion with C.
At the time and place specified in the subsection, the G Union loan applicant shall submit a forged loan transaction agreement to the head of the I Department in charge of the loan of the G Union who is aware of the forgery.
3. The defendant is guilty.
At the time and place mentioned in paragraph (1), C is the principal when submitting the forged loan transaction agreement and the confirmation document (written confirmation of the person liable for registration) prepared by a certified judicial scrivenerJ, a copy of the resident registration certificate in the name of D previously held by the Defendant, and a complete certificate of the real estate registration of the forest land in the name of D.
