Defendants shall be punished by a fine of KRW 2,500,000.

The Defendants did not pay each of the above fines.

Criminal facts

C A Co., Ltd. (hereinafter referred to as the "C") is a corporation that runs a construction business with 40 full-time workers, and is "D New Construction Corporation at Namyang-si, Namyang-si."

E Co., Ltd. is a company performing construction of reinforced concrete construction business, and E Co., Ltd. is a corporation performing construction of reinforced concrete construction business, which is a contractor performing construction of 11.484 billion won subcontracted from C for construction of 11.4 billion won.

F is a person in general charge of safety and health as a site manager of the instant construction project, and Defendant A is a person in general charge of safety and health as a person in charge of the instant construction site manager, Defendant B is a person in charge of safety and health as an employee of the instant construction site manager, and Defendant B is a person in charge of safety and health management related to the said structural part of the instant construction project, and the Defendants are co-responsibilitys who shall take necessary measures to prevent the danger when work is performed at a place

At around 15:20 on August 2, 2012, Defendants and F directed the victim G, an employee E, to visit the instant construction site and 1502 outer wall. The above work is conducted at a height of about 26 meters, but there is a very high risk that workers might fall, and thus, in such a case, Defendants and F, who are jointly responsible for the safety management of the said work, provide safety guards with safety belts and life jackets to ensure that they do not dismantle the life lines during the work, and provide safety education, such as safety rules, to ensure that they do not remove the life lines, and without installing safety net rules, such as safety rules, to prevent the fall, even if they were negligent in performing their duty of care to prevent the danger of fall at the lower part of the work site.
