피고인은 2011. 10. 31. 17:30경 서울 성북구 B종교단체에 찾아와서 저녁밥을 요구하며 행패를 부려 B종교단체 처사인 피해자 C(59세)이 밥이 없다고 말하며 절 밖으로 나갈 것을 요구하자 “십쌔기 내가 누구인 줄 아느냐”라며 피해자가 앉아있는 식탁을 발로 차며 주먹으로 얼굴을 2회 때려 폭행하였다.
