1. From October 17, 2007 to July 22, 2016, Defendant B’s 22,522,364 won to the Plaintiff and 5% per annum for this.
Reasons
1. Basic facts
A. On August 29, 1911, Nonparty G was assessed against the real estate listed in the separate sheet (hereinafter “instant land”) on August 29, 191, and the said G was established as his child H, I, and J.
B. As the above G died on April 19, 1913, the above G succeeded to the above G, and as the above H died without the descendants on October 11, 1928, K, his leader, when he succeeded to the family inheritance and the inheritance of property, completed the registration of ownership preservation on the instant real estate on December 19, 1928. The above I and the above J completed the registration of ownership transfer on the instant real estate on December 20, 1928.
C. The above I died on December 27, 1950 and succeeded to 1/2 of the real estate of this case by the inheritance of Australia, a South-North L, the Republic of Korea, inherited one-half of the real estate of this case.
The above L was killed on February 1, 199, and the inheritor succeeded to 1/2 of the instant real estate by inheritance by an independent party intervenor D through consultation, among the inheritors of the above L, even though there were D, N,O, P, Q, R, and T.
On July 25, 1968, the above J died. On July 25, 1968, as to one half of the instant real estate, Australia’s heir U 6/11, the 4/11 of the independent party intervenor E, and the 1/11 of the independent party intervenor F respectively.
In addition, the above U died on June 27, 198, and the heir was the wife, the plaintiff, the plaintiff, the son, the W, X, the Y, and Z, but the plaintiff succeeded to the above U U U's share solely in the agreement on the division of inherited property.
(However, the above Y and X renounced renounced inheritance)
E. On February 26, 1985, Defendant B (hereinafter only referred to as Defendant B’s clan) completed the registration of ownership transfer of the instant real estate on the grounds of the sale on September 10, 1971 under the Act on Special Measures for the Registration of Real Estate (hereinafter referred to as the “registration of ownership transfer”) and the Korea Land Corporation acquired the registration of ownership transfer of the instant real estate by consultation with the Defendant clan on October 9, 2007, by acquiring the land for public use on October 9, 2007.
