The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal states that the Defendant would immediately pay the price to the victim without intent or ability to pay the price, and that he/she was supplied with the homicide by the victim and acquired it by fraud.

2. The judgment of the court below is just in light of the reasoning of the judgment below, and the evidence submitted by the prosecutor alone is insufficient to acknowledge the facts charged, and there is no other evidence to prove otherwise. The judgment of the court below is just in light of the records and records.

3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
