The appeal is dismissed.

The grounds of appeal are examined.

Based on its stated reasoning, the lower court rejected the grounds of appeal on mistake of facts, on the grounds that the facts charged of this case (excluding the points of conflict as of March 30, 2007 and the part determined as not guilty and dismissed as of March 30, 2007) are recognized.

Examining the reasoning of the lower judgment in light of the evidence duly admitted, the lower court did not err by exceeding the bounds of the principle of logic and experience and the principle of free evaluation of evidence, by exceeding the bounds of the principle of judgment on evidence, court-oriented principle, deception in fraud, accusation, and its criminal intent, thereby adversely affecting the conclusion of the judgment.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
