The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for one year.

1. Summary of grounds for appeal;

A. The sentence imposed by the lower court on the Defendant (one year and two months of imprisonment) is too unreasonable.

B. The Prosecutor’s sentence imposed by the lower court against the Defendant is too uneasible and unreasonable.

2. Before making a judgment on the grounds for ex officio appeal, the record reveals that a prosecutor stealss the victims’ property worth KRW 5070,000,000 in total seven times among the charges of habitual larceny, which were originally prosecuted at the lower court.

“A total of 7,082,00 won was stolen from the victims’ property in total over 10 times, such as the list of crimes in the attached sheet.

“Along with the change of the purport of “” and the addition of paragraphs 8 through 10 in the annexed list of crimes to the effect that each of the following changes was made, the lower court, upon which each of the above additional charges was permitted, filed an application for permission to amend the Bill of Amendment. However, the lower court, without omitting the judgment as to the above additional charges, made it clear that the judgment of the lower court committed an illegal act that found the Defendant guilty of habitual larceny charges as the object of the remaining charges of larceny, by making it clear that the added charges of habitual larceny and the remainder of the charges of habitual larceny are in the relation of a single crime, and the other charges of habitual larceny are in the relation of concurrent crimes under the former part of Article 37 of the Criminal Act. As such, the lower court’s judgment should be reversed in its entirety.
