A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On October 2, 2017, at around 20:40 to 20:50, the Defendant: (a) was working in the 20-dong-gu, Daegu-gu, Daegu-ro 20-ro 108-dong-dong-ro 108-dong-dong-dong-dong-dong-gu; (b) the Defendant argued that the Defendant would drive a vehicle and go through the 29-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-gu, and that the Defendant would bring about the victim’s left part of the vehicle due to the vehicle traffic problems; and (c) once, after being asked of the victim’s situation from the police officer dispatched after receiving the victim’s 112, the Defendant assaulted the victim by taking the victim

2. 공무집행 방해 피고인은 2017. 10. 2. 22:10 경 대구 동구 C에 있는 대구 동부 경찰서 D 지구대 안에서, 제 1 항 기재 범죄사실로 현행범인 체포되어 조사를 기다리다가 위 지구대 소속 경사 E에게 “ 손목이 너무 조이니 수갑을 조금만 풀어 달라 ”라고 말하였으나 그로부터 “ 지금 다른 사건 때문에 수갑 열쇠가 없으니 잠시 기다려 달라” 라는 말을 듣자, 갑자기 “ 개새끼야” 등의 욕설을 하며 “ 내 경찰관 3명 얼굴 기억해 놨다, 나는 곧 풀려 나갈 것이니 칼을 가지고 너희들 3명을 찔러 죽이겠다, 내가 못할 것 같제 ”라고 말하고, 위 E을 가리키며 “ 특히 너 새끼 조심해 라 ”라고 말하여 위 E을 협박하였다.

Accordingly, the defendant interfered with the legitimate execution of police officers' duties in relation to the prevention, suppression and investigation of crimes.

1. The former part of Article 37 of the Criminal Act, Article 38(1)2, and Article 50 of the Criminal Act (the punishment is more severe, concurrent crimes resulting from the obstruction of performance of official duties, and two crimes.
