1. The defendant shall pay to the plaintiff the amount of KRW 45,463,920 and the above amount of KRW 44,189,02 from August 6, 2014.
Reasons
1. Indication of claim;
A. On August 13, 2012, the Plaintiff set a loan to the Defendant at KRW 182,00,000, interest rate of KRW 11.9% per annum, and interest delay damages at KRW 18% per annum.
B. From July 5, 2014, the Defendant lost the benefit of time on August 5, 2014 by failing to repay the principal and interest.
At the time, the principal and interest of the above loan was KRW 45,463,920, and the principal was KRW 44,189,022.
C. Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay calculated by the rate of 18% per annum from August 6, 2014 to the date of full payment, with respect to the principal amounting to KRW 44,189,02, out of the above loans and the principal amounting to KRW 45,463,920, and the above loans.
2. Judgment by publication of the basis (Article 208 (3) 3 of the Civil Procedure Act).
