[2017 order 6]
1. On October 25, 2016, the Defendant posted a notice stating that the Defendant’s smartphone display is selling the Defendant’s smartphone display in the Internet website bulletin board, and made a false statement as if he/she would send the Defendant’s sales proceeds to C, who reported and contacted the said notice, to the victim C, who remitted the sales proceeds.
However, the defendant did not have the above crowdfunding and did not have any intention or ability to sell the crowdfunding.
The Defendant: (a) deceiving the victim as above; (b) received 520,000 won under the name of the sales proceeds of the said crowdfunding from the injured party around that time; and (c) from that time until February 5, 2017, by deceiving 15 victims, such as the attached Table 1 in the same manner until February 5, 2017, and was issued KRW 7,372,50 in total on 15 occasions by deceiving 15 victims, such as the attached Table 1.
[2017 Highest 67] The Defendant had a prior possession of a cell phone after arbitrarily opening a cell phone under D’s name and receiving a request for termination of a mobile phone use contract from D.
Using identification cards, etc. of E in the name of E, the mobile phone service contract opened in the name of D was put to change it in the name of E.
2. On December 16, 2015, the Defendant: (a) placed a physical check in the column for the change of the name of the application for subscription to the mobile phone at G mobile phone sales stores located at the 1st floor of the apartment building located at the entrance of the Busan Shodong-gu, Busan; (b) placed a written application for change in the name of “E” in the name of the purchaser column and the name of the subscriber; and (c) made a written application for change in the name to transfer the mobile phone (H) in the name of “E” in the customer address column; and (d) sent the file in which the application for subscription can be processed to E using the computer, to the non-personal employees working for the EL branch Plus agents.
Accordingly, for the purpose of uttering, the defendant applies for membership in the name of E, a private document concerning rights and duties.
