A. B. On October 31, 2016, the Plaintiff provided medical care and claimed disability benefits.

On November 29, 2016, the Defendant determined the Plaintiff’s disability status as follows, and determined the final disability grade 10 (hereinafter “determination of the existing disability grade”) by adjustment (if there are at least two disabilities of grade 13 or higher, one higher grade).

(1) A person who has suffered from a scarcity functional disorder in 19% - among class 7 of grade 11 (scarcity 11-12 ) (27% of the scarcity functional disorder in scarcity 11-12) - a person who has left from a scarcity functional disorder in scarcity 11-7 (scarcity 12-day 2) (scarcity 12-day 3) - a person who suffers from a scarcity chronic disorder in scarcity 12-day 16 (scarcity in scarcity 12 and 2).

C. At the time, the Plaintiff filed an administrative litigation against the determination of the above disability grade, but lost at the first instance court (Seoul District Court Decision 2017Gudan20228 Decided July 19, 2017). Although the Plaintiff appealed, the judgment of the first instance court became final and conclusive due to the dismissal of the appeal.
