A Imprisonment of 1 year and 2 months, Defendant B, and C, respectively, shall be punished by a fine of 3,00,000 won.

Punishment of the crime

1. Defendant A

A. Violation of the National Sports Promotion Act and the Defendant of a gambling opening place are those who operate a single-name “J” website (hereinafter “K,L, and M, etc.”) that is a gambling site that has a server in Japan.

No person, other than the Seoul Olympic Sports Promotion Foundation or an entrusted business entity, shall issue sports betting tickets or similar things (including the issuance thereof by means of information and communications networks) and provide property or financial benefits to persons who win at the betting results, and no person shall open gambling for profit.

Notwithstanding the fact that the Defendant is not an entrusted business entity of the Seoul Olympic Sports Promotion Foundation, from the end of December 2010 to the end of September 12, 2012, the Defendant established an office in Gangnam-gu Seoul Metropolitan Government National Sports Promotion Foundation 103 to operate the said site on the website, posted the rate of dividend in accordance with the domestic and overseas sports games, such as stables, camping districts, and farming districts, and each sport plaque, and deposited money into the Defendant’s account designated by the members of the said site at the same time: (a) filled up members with electronic money equivalent to the same amount used for hosting the money; and (b) made the members of the said site buy the electronic money equivalent to KRW 1,00,000 at a minimum of KRW 5,00 and KRW 1,000,000; and (c) paid the winning money to the members of the said site in accordance with the results of the sports; and (d) paid the winning money to the members of the Plaintiff for the purpose of opening the said 700 Do85, etc.

B. The Defendant who violated the Act on the Regulation and Punishment of Criminal Proceeds Concealment shall open gambling as provided in the preceding paragraph.
