Reasons
1. Facts of recognition;
A. On July 1, 2008, the Plaintiff entered into a lease agreement with the Daesung Co., Ltd. (hereinafter “MS”), with a deposit of KRW 1468.3 square meters for the first floor factory, KRW 28 million for the second floor office, KRW 1006.95 square meters for the second floor, KRW 9,356,45 square meters for the monthly rent, from July 1, 2008 to June 30, and with a lease agreement of KRW 893.20 square meters for the real estate listed in the attached Table 2 for the period from July 1, 2008 to June 30, 2010, the Plaintiff leased the lease agreement as above from July 1, 2008 to June 30, 2010 for the lease agreement of KRW 10 million for the rent of KRW 3,376,296 for the month, and from July 1, 2008 to June 30, 2010.
B. Since July 2010 and July 2012, the instant lease agreement was renewed on December 30, 2013, and the Plaintiff notified IMS of the termination of the instant lease agreement on four occasions on April 23, 2014, and May 30, 2014, and notified IMS of the termination of the term.
다. 대일엠티에스는 임대 목적물을 인도받아 차츰 점유 면적을 넓혀 나가고, 임대 목적물 중 일부는 원고에게 반환한 결과 현재 별지 목록 1)항 기재 부동산 중 별지 도면 1)-1 표시 ⑴,⑵,⑶,⑷,⑸,⑹,⑺,⑻,⑼,⑽,⑾,⑿,⒀,⒁,⒂,,,,⑴의 각 점을 순차 연결한 선내 부분 2086.43㎡, 별지 도면 1)-2 표시 ⑴,⑵,⑶,⑷,⑴의 각 점을 순차 연결한 선내 부분 1006.95㎡, 별지 목록 2)항 기재 부동산 중 별지 도면 2)-1 표시 ⑴,⑵,⑶,⑷,⑴의 각 점을 순차 연결한 선내 부분 371.54㎡, 별지 도면 2)-2 표시 ⑴,⑵,⑶,⑷,⑴의 각 점을 순차 연결한 선내 부분 67.095㎡(307, 308, 309호실)를 각 점유하고 있다. 라.
WS is declared bankrupt on August 8, 2016 (Seoul District Court 2016Hahap5019), and the defendant, the bankruptcy trustee, was MS. in the lawsuit of this case.
