1. The Defendants are jointly and severally and severally liable to the Plaintiff for 55,291,389 won and 5% per annum from February 27, 2015 to December 14, 2016.

1. Facts of recognition;

A. On October 1, 2013, the Plaintiff entered into a service contract with the Defendant A with a subcontract for the new apartment construction work from the Han New Public Co., Ltd., and entered into the following terms:

1. On-site name: Construction of a new apartment;

2. The name of the subcontracted project: Domestic wooden project;

3. Construction site: Gangseo-gu Busan Metropolitan City D;

4. Period of construction: October 1, 2013 after the commencement of construction: July 30, 2014.

5. Contract amount: Won-gu0 million won (Won 590,000,000).

6. Payment of the price: To be made on the 20th day of following month in accordance with the progress rate of on-site recognition.

7. Method of payment: Cash.

8. The rate of warranty bond (10%): Won 59,000,000 won;

9. Period of defect liability: The rate of liquidated damages for delay on two years and ten days from the completion date: 3/100 for each one day, each of the parties shall enter into this construction subcontract with the above contents and the additional construction subcontract terms, design drawings and specifications, and prepare two copies of each contract, respectively.

B. The Defendants, around July 4, 2014, drafted a settlement agreement with the following contents and provided it to the Plaintiff.

The name of the construction project: The amount agreed upon between the parties to the agreement in Gangseo-gu Busan Metropolitan City (Won 634,379,000) on the settlement of accounts in Gangseo-gu, Busan Metropolitan City: 1) B: confirm that the above amount was increased by 44,379,000 won for the last volume out of 590,000,000 won for the initial contract amount of the construction project, the above amount shall be the amount increased by 44,379,000 won for the last volume; according to the settlement of the agreement, the above amount of the agreement shall be promised to be responsible for all wages, food, expenses, etc. incurred in the construction project and shall be paid within the extent of the balance (Won 59,314,295) excluding Won 35,064,705) paid by June 30, 2014.
