Reasons
Punishment of the crime
around September 28, 2012, the Defendant made a false statement to the victim C, who had come to know of the fact through Internet hosting, stating that “When he/she operates a fish-combined business, he/she will use the card if he/she lends a credit card, and make a full payment upon receiving the construction cost.”
However, in fact, the defendant did not operate a fish-combined business, and even if he borrowed a card from the victim, he did not have an intention or ability to pay the card price.
The Defendant received, respectively, one copy from the victim, one copy of the Hyundai Card, one copy of the People’s Card, and one copy of the Scandon Card, two new cards, Samsung Card, and one copy of the National Card on March 15, 2013, and one copy of the Samsung Card, respectively.
From September 28, 2012 to April 8, 2013, the Defendant received cash services equivalent to a total of KRW 46,651,200, or purchased goods, etc. on a total of 101 occasions, as indicated in the annexed crime list, and had the victim receive economic benefits equivalent to the same amount by subrogation.

1. Around 03:40 on June 17, 2013, the Defendant threatened the victim by having a cell phone (tele number: E) call from the Defendant’s residence located in Heung-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, with a portable phone of the victim F (the victim’s 44 years of age) to file a criminal complaint against the Defendant by fraud.
