A defendant shall be punished by imprisonment for a term of two years and two months.

The defendant is a fraudulent damage, and 200,000 won to E who is an applicant for compensation.

Punishment of the crime

Around December 25, 2018, the Defendant posted a letter of sales of crowdfunding to F, which is a website for used goods transaction via the Internet, and falsely told the victim G, who reported and contacted the letter, that “I will send the franchise of 160,000 won to online. I will send the franchise of 30,000 won.”

However, the defendant did not actually possess the above goods, and only thought that he received the price from the victim to use it as a deposit fee to the illegal sports earth site account, and even if he received the price from the victim, he did not have an intention or ability to send the above goods.

Nevertheless, the Defendant, by deceiving the victim as above, received KRW 160,00 from the victim to the H association account under the name of the Defendant and received KRW 12,659,389 in total from the victims 69 times in total, as shown in the attached Table 1, from February 23, 2019, as well as from the time to February 23, 2019.

Around December 24, 2018, the Defendant posted a gallon S7 mobile phone sales text to F, a website for used goods transaction on the Internet, and falsely read that “When sending KRW 150,000,000,000 to gallon, S7 mobile phone machine will be sent to gallon-type.”

However, the defendant did not actually possess the above goods, and only thought that he received the price from the victim to use it as a deposit fee to the illegal sports earth site account, and even if he received the price from the victim, he did not have an intention or ability to send the above goods.

Nevertheless, the defendant deceivings the victim as above, and receives KRW 1.50,000 from the victim as the price for goods to the H association account under the name of the defendant, and from that to February 23, 2019, the sum of 111 times in total, as shown in the attached Table 2, from the victims, as shown in the attached Table 2.
