A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

피고인은 2019. 9. 11. 03:17경 서귀포시 B에 있는 C편의점 앞 도로에서 피해자 D(67세)가 운행하는 E 택시에 승차하여 서귀포시 신효동으로 이동하던 중, 같은 날 03:25경 서귀포시 F에 있는 G조합 본점 앞 도로에서 피해자가 택시를 일시 정차하고 목적지가 어디인지 묻자 갑자기 피해자에게 “여기서 좌회전이라고 씨발놈아, 너 내려 씨발 개새꺄, 내려!”라고 욕설을 하면서 차량에서 내려 운전석으로 가, 운전석 문을 열고 주먹으로 피해자의 얼굴과 몸을 수십 회 때리고, 자리를 뜨는 피고인을 피해자가 따라오자 재차 주먹으로 피해자의 얼굴과 몸을 수십 회 때려 피해자에게 약 3주간의 치료를 요하는 어깨관절의 염좌 및 긴장 등 상해를 입게 하였다.
