Punishment of the crime

around 13:30 on December 30, 2019, the Defendant assaulted the victim's face by drinking, i.e., raising his/her body on the ground that he/she is a victim with no name (a person with approximately 40 years of age, height, large body size) within the Bupyeong-gu Incheon Bupyeong-gu B market department, Bupyeong-gu, Incheon.

Around September 2019, the Defendant and C filed a report to C on the ground that C had stolen his or her eavesma within the Bupyeong-gu Incheon Bupyeong-gu D Public Notice Board, and the Defendant was subject to three times a report or complaint to punish C, and on the contrary, C was subject to a disposition that there was no suspicion. On the contrary, when C filed a report on suspicion of injury from the Defendant, it would be subject to a disposition of prosecution.

For the foregoing reasons, although the Defendant did not have committed an assault, such as cutting the Defendant with the Defendant, the Defendant was assaulted by C, and was willing to make a false report to the police.

이에 피고인은 2020. 1. 8. 08:33 경 위 고시원에서, “ 아는 사람이 발로 찼다” 고 112 신고를 한 다음 출동한 경찰관에게 동일한 취지의 진술서를 작성하고, 2020. 1. 28. 경 인천 부평구 길 주로 511에 있는 인천 부평 경찰서 형 사과 형사 1 팀 사무실에서 위 신고 내용에 대한 보충 진술을 하면서 담당 경찰관에게 “2020. 1. 8. 08:30 경 D 고시원 3 층 공용 주방 내에서 C로부터 발로 다리 쪽을 두 대 맞았으니 C를 처벌해 달라” 고 진술하였다.
