C은 위 부동산을 3,150,000,000원에 피고 등과 매매예약을 다음 조건으로 체결한다. 1. 피고 등은 본계약과 동시에 위 매매대금 내에서 예약금 300,000,000원을 C에게 지급한다. 4. 피고 등은 위 잔대금 2,850,000,000원을 2009. 1. 31.까지 C 등에게 지급하고, 동시에 C 등은 소유권이전등기 절차 서류를 완비하여 피고 등에게 교부하고, 동 부동산을 인도한다. 2) 피고 등은 이 사건 매매예약일 무렵 C에게 이 사건 매매예약에 따른 계약금 300,000,000원을 지급하였다.
