Defendant
A is a real operator of Defendant B, who is an exporter of steel products in Jung-gu Seoul, Jung-gu.
1. No person who violates the Foreign Trade Act shall export or sell any goods, etc. produced in a foreign country as if the country of origin of such goods, etc. is the Republic of Korea, by forging or altering the certificate of origin, obtaining the certificate of origin with false content, or falsely indicating the origin of such goods, etc.;
Nevertheless, around June 21, 2013, the Defendant exported the amount equivalent to 3,120 km (7,503,014 won at the market price) of Korean steel products in Busan, Jung-gu, Busan, and 3,120 km (7,503,014 won) from the Republic of Korea, and exported them to Vietnam by pretending the country of origin of the above goods to be issued in the Republic of Korea. From around that time to May 7, 2015, the Defendant exported the total amount of 117,122 km (359,639,621 won at the market price) of Korean steel products in total six times as indicated in the list of crimes in attached Table.
(2) When it is intended to import, export or return goods in violation of the Customs Duties Act, the name, standard, quantity, storage, place, origin, etc. of such goods shall not be falsely declared.
Nevertheless, on March 12, 2015, the Defendant exported 13,200 g (70,023,597 won at the market price) of Korean steel products to the Busan Customs office located in 20 as the Busan Central Customs office, and falsely exported the said goods to Korea. On May 7, 2015, the Defendant exported 20,200 g (58,469,096 won at the market price) of Korean steel products at the above Busan Customs office, and filed a false export declaration on the origin of the said goods to Korea.
2. Defendant B (1) Violation of the Foreign Trade Act is the date, time, place, and employee as described in paragraph (1) of Article 1, and the contents as described in paragraph (1) of Article 1 with respect to the above A’s business.
