The defendant in the short-term visit (C-3) is a Chinese national foreigner who is staying in the Republic of Korea, and the victim C (16 years of age) is a Chinese national foreigner who has a ship parent residing in the Republic of Korea.

피고인은 2017. 12. 28. 경 중국 채팅 애플리케이션인 D의 구인란에 ‘ 서울 홍 대 입구 거리 관광을 안내해 주면 한 시간당 5만 원을 주겠다’ 라는 취지의 광고를 올려, 위 광고를 보게 된 피해자와 연락하게 되었고, 피해자와 2017. 12. 30. 경 신도림 역 인근에서 만날 약속을 잡게 되자, 중국에서 미리 구하여 가지고 들어온 성분 불상의 수면제를 잘게 빻아 가루형태로 만들어 종이에 담아 포장한 후 주머니에 소지하여 위 약속 장소에 나가, 피해자와의 식사 자리에서 이를 몰래 피해자에게 먹여 피해자의 정신을 혼미하게 한 다음 피해자에 대한 성폭력 범행에 나아갈 것을 계획하게 되었다.

1. On December 30, 2017, the Defendant, in violation of the Act on the Protection of Children and Juveniles against Sexual Abuse, moved from the victim and the Seoul New Dok Forest Station to the red-entry zone, sent time in the vicinity of the red-entry zone by the victim’s instruction, from 17:43 to 18:50 on the same day, he/she provided meals with the victim at the “F” restaurant located in Mapo-gu Seoul Metropolitan Government E.

피고 인은 위 식당에서 식사를 하면서 맥주 6 병을 시켜 피해자에게 그 중 절반 가량을 마시게 한 뒤, 피해자가 화장실에 다녀오겠다며 자리를 비운 틈을 이용하여 피해자의 술잔에 2회에 걸쳐 위와 같이 미리 잘게 빻아 준비하여 온 성분 불상의 수면제 불상량을 몰래 넣고, 피해자가 화장실에서 돌아오자 피해자에게 “ 마지막 잔을 마시고 나가자 “라고 말하여 남은 맥주를 마시도록 권하여, 피해 자가 위와 같이 술에 섞은 수면제를 섭취하게 하였다.
