피고인은 2015. 4. 1. 23:00경 용인시 수지구 C에 있는 D 주점에서 피고인이 평소 자주 다니던 다방의 종업원인 피해자 E(여, 46세)과 함께 술을 마시던 중 피해자의 술잔에 수면제를 타 피해자로 하여금 정신을 잃게 한 후 피해자를 근처 모텔로 데려가 강간하기로 마음먹고, 2015. 4. 2. 00:55경 위 주점에서 피해자가 화장실에 간 틈을 이용하여 미리 소지하고 있던 수면제 포린피아정 1개를 젓가락으로 빻아 가루로 만든 후 피해자의 술잔에 몰래 넣어 화장실에서 돌아온 피해자로 하여금 그 술잔에 들어 있는 술을 마시게 하였다.
