Reasons
Punishment of the crime
The defendant is a person who operates an entertainment planning company B.
1. No person who violates the Immigration Control Act shall invite an alien or arrange such invitation by fraudulent means, such as a false fidelity guarantee, to allow the alien to enter the Republic of Korea;
On January 9, 2017, the Defendant, as part of multi-cultural events, was given a public performance in C under the support of the Korean Music Federation, which is a part of the multi-cultural events, and was bound to request the State to issue the visa by allowing D to do so.
Along with the short-term comprehensive (C-3) visa that is not granted to a person for profit in Mongolia on the 13th day of the same month by preparing a invitation letter, the reason for invitation, etc. and providing D with such a letter, etc. to D, and allowing D to obtain a visa for profit-making purposes.
However, in fact, the Defendant invited Da, who had a d's leisure time, planned to perform a paid performance with KRW 35,000 per person, against 35,00 in the “F” located in the Gangnam-gu Seoul Metropolitan Government, and entered as if D were to invite a short-term comprehensive employment visa (C-4) that would be easily issued when D enters the Republic of Korea for profit purposes, to enter the Republic of Korea with a non-profit-making business by obtaining a short-term employment visa (C-3) visa.
Accordingly, the defendant invited a foreigner through false statement, etc.
2. A person who intends to invite foreigners in Korea to hold a public performance, shall obtain the recommendation of the Korea Media Rating Board, and foreigners who fail to obtain the said recommendation shall be prohibited from holding a public performance in Korea, except as otherwise prescribed by the Act;
The Defendant invited D, as referred to in paragraph (1), to play a performance of D, on January 28, 2017, without obtaining the recommendation from the Korea Media Rating Board (Korea Media Rating Board). On January 28, 2017, at around 17:00 to 20:00, the Defendant received entrance fees of KRW 35,000 from F, and 450, a steel frame staying in Korea.
