A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Any person who violates the Food Sanitation Act shall report to the competent authorities on general restaurant business;

피고인은 2012. 5.경부터 2013. 1. 28. 11:00경까지 신고하지 않고 구리시 B이라는 상호로 15평 정도의 가옥에 20평 정도 되는 가건물을 세운 후, 그 안에 테이블, 탁자 등 손님을 접대할 수 있는 시설을 갖추고, 음식을 먹으러 그 곳을 찾는 손님들에게 월 평균 200만 원 상당의 닭도리탕, 백숙, 옻닭 및 주류를 판매하여 일반음식점 영업을 하였다.

2. Slaughter and treatment of livestock, milk collection, processing, packing and storage of livestock products in violation of the Livestock Products Sanitary Control Act shall be conducted at each workplace permitted by the competent Mayor/Do Governor;

The Defendant, while running a general restaurant business on the above date and at the above place, prepared to the customers who ordered food and prepared it for the purpose of sale, was not a place of business permitted for the purpose of sale, but was slaughtered and treated after being equipped with a horse, handcas, handcas, etc.
