Punishment of the crime

1. Defendant A is a person who operates a general restaurant in the Gangseo-gu Seoul Metropolitan Government “F-cafeteria B”.

A person who sells or provides agricultural and fishery products or the processed products thereof after cooking shall not place a false indication of the place of origin or place a mark likely to cause confusion therewith.

그럼에도 불구하고, 피의자 A은 2015. 1. 8.~2015. 3. 23. 기간 동안 위 음식점에서 부천시 오정구 소재 ‘G’ 외 2곳에서 미국산 돈목전지 48.15kg 을 1kg 당 6,000원에, 중국산 배추김치 190kg 을 1kg 당 1,090원에, 미국, 중국산이 혼합된 쌀 20kg 및 중국산, 국내산 찹쌀이 혼합된 쌀 120kg 도합 140kg 을 1kg 당 1,950원에, 호주산 소 전각 16.2kg 을 1kg 당 10,600원에, 각각 구입하여, ① 2015. 1. 2.~2015. 3. 23. 기간 동안 미국산 목전지 48.15kg 으로 조리한 제육볶음을 제육 된장찌개 모듬쌈 메뉴로 268인분을 1인분당 7,500원에 시가 2,000,000원 상당, 제육 추가 6개 45,000원 상당 도합 2,045,000원 상당을 제공하면서 원산지를 국내산으로 거짓표시하였다.
