Defendant shall be punished by a fine of KRW 5,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

1. From Sep. 1, 200 to Oct. 31, 2010, the Defendant was in charge of a total of KRW 71 cases, including research tasks supervised by the Ministry of Commerce, Industry and Energy from Mar. 1, 2007 to Oct. 31, 2010, as D public college machinery engineering and professors, and of KRW 35.1 billion in total (68,646,00 in total of KRW 35 research costs, KRW 6.68,646,00 in total, KRW 36 research costs, KRW 28.16,357,00 in total, KRW 28.56,357,00 in total, KRW 36 research costs). Of the research costs, the Defendant became in charge of a total of KRW 11.10,743,756 in attached Table 1 researchers, including victim E, including the victim E, with labor costs, research allowances, travel expenses, scholarships, etc.

The Defendant: (a) had the victims participate in a research assistant; (b) transferred all the above personnel expenses paid to them to the F Bank account in the name of the Defendant (G; hereinafter “Joint Management 1 account”); (c) had F Bank account in the name of the Defendant (H; hereinafter “Joint Management 2 Account”) additionally opened an F Bank account in order to prevent financial accidents from causing a large balance and to distribute and manage balance; and (d) transferred KRW 67,000,000 from the Joint Management 1 account to the Joint Management 2 account from April 28, 2008 to September 9, 2010; and (d) had the Defendant manage the expenditure expenses for the period from the Defendant’s awareness-raising year (from September 1, 2006 to August 31, 207) to the F Bank account in the name of the F Bank (hereinafter “Joint Management 2 Account”).

The defendant directly managed one account under joint management and two accounts under joint management as Internet banking, and dealt with various deposits and withdrawals, and the I, with the approval of the defendant, dealt with the entry and withdrawals of the laboratory operation fund account.

However, most of the funds deposited in the above joint management account, joint management account, and laboratory operation account are paid to the victims as personnel expenses paid by the industry-academic cooperation foundation to 24 victims.
