The defendant's appeal is dismissed.
Reasons
1. The following facts are acknowledged according to the evidence duly admitted and examined by the lower court and the trial court.
A. The victim company that developed the program (hereinafter the victim company) is a company that researches and produces DVR (DVR, a CCTV video monitoring and storage system that is saved by converting the DNA image signal from a cross-border border and CCTV camera into digital format). From 2001 to 2003, the company developed AJ, AK, and H model by integrating various functions necessary for DVR's core technology into a single chip called FPG, and simultaneously processing the maximum of 32 MVG signals from around 2004, MV model from around 2003 to around 205, and around 207 model from around 207.
B. (i) On August 11, 2003, the Defendant entered the victim company as the director of the division and worked at the research institute 4 teams affiliated with the victim company, and was in charge of designing and developing the FPGA together with the joint representative AL, the director of the research institute S, the research institute AF, etc., the head of the team at around June 2005, and the promotion of the FPGA at the head of the team at around 2007.
on September 6, 2003 and January 16, 2006, the defendant agreed that the right to the information developed by the defendant in the course of the technical development, invention, or any other work related thereto is the ownership of the victim company and submitted a confidentiality pledge to the victim company that the defendant will not divulge any confidential information that he/she has learned during his/her tenure of office after his/her retirement.
C. (1) On April 2004, the Defendant received the FPGA development proposal from E and consented thereto. On May 24, 2005, the Defendant entered into a consignment development agreement with E on May 24, 2005 on the “FPGA” with E, and entered into an entrustment development agreement with E on May 24, 2005, with E as the development cost of KRW 35 million.
