1. The Defendant’s KRW 6,228,650 as well as the annual rate from December 1, 2017 to May 16, 2018, and the next day.
Reasons
1. On May 2014, the Plaintiff entered into a lease agreement with the Defendant and operated a swimming pool (hereinafter “instant lease agreement”) with regard to the 901st class of the building C in Yongsan-gu, Yongsan-gu (hereinafter “instant commercial building”).
A lessor: The lease deposit for the Plaintiff from May 15, 2014 to May 14, 2017: 30,000,000, and the rent: The lease contract is terminated on the 15th day of each month, if the lease contract is terminated, the lessee shall restore the above real estate to its original state and return it to the lessor, and the lessor shall return the deposit.
Special Agreement - Upon expiration of the contract, the lessee shall not make any additional claims, such as premium, facility cost, beneficial cost, cost, development cost, etc. which have not been paid to the lessor, and shall be responsible for damage to all the facilities arising from the management.
- The lessor shall bear ten million won of a swimming construction cost, and the lessee shall pay five hundred thousand won per month for interest, depreciation costs, cost of establishing deposit, etc. for ten years.
And all liabilities for the future construction work shall be borne by the lessee.
Construction cost details: All of the 4th automatic control unit 9th floor boilers and accessories, the replacement and repair of pumps rooms below the 9th floor, the replacement and repair of the 3rd side gates of the floor of a swimming pool toilet, the replacement of a child swimming pool, the replacement of some parts of a swimming pool, the repair of damaged parts of a swimming pool, the replacement of a swimming pool floor - the replacement of the ebbbbbbbbial floor at the time of lease, the lessor is responsible for all parts other than the repaired parts.
On November 15, 2017, the Defendant asserted that the instant lease agreement was terminated, and filed a lawsuit against the Plaintiff seeking the delivery of the instant commercial building (this court 2017da8718), and the court rendered a judgment that “the Plaintiff shall deliver the instant commercial building to the Defendant, and pay the amount calculated at the rate of KRW 4,350,000 per month from August 15, 2017 to the delivery date.”
