피고인은 2014. 9. 29. 13:00경 광주 남구 C 앞 노상에서 옆집 거주자인 피해자 D(63세,여)이 자신의 집 앞에 세워 놓은 주차방지용 돌을 치웠다는 이유로 “똥깔보 같은 년, 도둑년”이라고 욕설을 하면서 쓰고 있던 우산을 접어 눈을 파버린다며 위협하고 손으로 그녀의 머리채를 1회 잡아 당겨 폭행하였다.
