1. Defendant B: (a) the Plaintiff (Counterclaim Defendant);

A. Of the area of 165 square meters in Gwangju City D Do, the indication of the attached drawings shall be made by the C 3, 4, 12, 3.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Facts of recognition;

A. As to the ownership of real estate (i) ownership of real estate (i.e., 165 square meters in D miscellaneous land in Gwangju City (hereinafter “D land”), and as to the above ground-based Domen and 57.32 square meters in a single-story house (hereinafter “the Plaintiff’s housing”), each transfer registration under the name of F on December 5, 1989, and on October 24, 1990 was completed on November 30, 201, on which the Plaintiff’s ownership transfer registration was completed on December 9, 201.

B. In the case of Gwangju City, the land of this case (hereinafter “E”) is owned by Defendant C, and the cement brop roof studs, which is the ground building (hereinafter “Defendant B’s building”) is owned by Defendant B.

나. 부동산의 현황 ⑴ 이 사건 D 토지 지상의 이 사건 원고 주택 중 일부인 시멘트 블록 담장 및 철제 대문은 피고 C 소유인 E 토지 중 별지 도면 표시 10, 11, ㄷ, ㄴ, ㄱ, 10의 각 점을 순차로 연결한 선내 ㈑ 부분 14㎡[이하, ‘선내 ㈑ 부분‘이라고만 한다]를 침범하여 그 지상에 축조되어 있다.

⑵ 반면, 피고 B의 건물은 그 일부가 원고 소유인 이 사건 D 토지 중 별지 도면 표시 ㄷ, ㄹ, 12, ㄷ의 각 점을 순차로 연결한 선내 ㈏ 부분 3㎡[이하, ‘선내 ㈏ 부분’이라고만 한다]를 침범하여 축조되어 있다.

다. 선내 ㈏ 부분의 임료 상당액 이 사건 선내 ㈏ 부분의 2011. 11. 30.부터 2013. 3. 30.까지의 임료 상당액은 207,000원이고, 위 부동산의 2013. 3. 30. 기준 토지 시가는 4,107,000원이며 부동산 임대로 인한 기대이율은 연 4%이다.
