The reasoning of the judgment of the court of first instance, which is to be presented by this court, is that part of the reasons of the judgment of the court of first instance, including the judgment on the party's allegations and evidence submitted at the court of first instance, is the same as that of the relevant part of the reasons of the judgment of the court of first instance, except for the judgment on dismissal or addition as set forth in paragraphs 2 and 3 below. Thus,

The plaintiff appealed at the end of paragraph 1, and deleted the part (No. 6) below, and add the following:

On December 13, 2017, the Appellate Court (Seoul High Court 2016Nu81668) accepted the Plaintiff’s appeal and revoked the said disposition on the ground that “The Deceased caused depression due to stress in the performance of official duties, and caused suicide to the extent that it would be difficult to expect reasonable judgment due to his/her normal recognition ability, ability to choose action, mental suppression, or considerable decrease in his/her ability to control, thereby resulting in suicide. Therefore, proximate causal relation between the deceased’s duties and the death may be recognized.” The Public Official Pension Service appealed against the above appellate court, and appealed the said disposition. However, the Supreme Court dismissed it on April 26, 2018.”

3. Additional determination

A. (1) Determination as to whether a proximate causal relation exists between the defendant's illegal act and the deceased's death (1) The plaintiff's assertion that sexual harassment occurred in the workplace several times by neglecting the sexual discriminatory working environment, and did not perform properly the duty to take measures following the occurrence of sexual harassment. The deceased's act committed suicide due to bad depression that occurred while working in the work environment aggravated, and thus, a proximate causal relation between the defendant's illegal act and the deceased's death should be acknowledged.
