1. Of the judgment of the first instance court, the part against the plaintiff falling under the order to revoke below shall be revoked.

1. Details of the disposition;

A. On September 2, 2002, the deceased B (hereinafter “the deceased”) was appointed and served as police officers, and committed suicide by hanging down the items at the top of the entrance door at home-to-door entrance on February 14, 2010.

B. On March 11, 2010, the Plaintiff, a wife of the deceased, claimed compensation for survivors to the Public Official Pension Service. On April 2, 2010, the Public Official Pension Service rendered a disposition on the compensation for survivors’ compensation land on the ground that “The deceased is considered to have committed suicide due to external factors of official duties, such as resistant arbitras who had a more sensitive response to stress, or who resulted from the growth process, etc., and on the ground that the deceased cannot be deemed to have committed suicide in a state of extreme mental disorder or mental disorder due to reasons of official duties, and thus it is difficult to regard the deceased’s death as a disaster on official duties.”

C. On July 13, 2012, the Seoul High Court 201Nu31606 filed an administrative litigation against the Public Official Pension Service seeking cancellation of the disposition on the compensation for bereaved families’ compensation, and received a favorable judgment of the Plaintiff on the ground that “The deceased caused depression due to the deceased’s official duties, such as patrol, while serving in the D Zone as a police official, and it can be inferred that the deceased’s normal perception, ability to choose action, and mental suppression may result in suicide due to such depression, and there is a proximate causal relation between the deceased’s official duties and the deceased’s death as a police official, and the said judgment became final and conclusive by dismissing the appeal of the Service on December 13, 2012.”

On January 24, 2013, the Plaintiff filed an application with the Defendant for registration of a person who has rendered distinguished services to the deceased. On July 17, 2013, the Defendant died on the ground that “the deceased was directly caused by the deceased’s performance of duties or education and training as a police official.”
