A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The defendant is in violation of the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. On September 16, 2014, around 22:15, the Defendant arranged commercial sex acts in the same manner at the above business place from the end of January 2014 to September 16, 2014, by receiving KRW 90,000 won from customers and allowing female employees to engage in similar sexual intercourse that may stimulate the sexual organ of the customers by hand, and by allowing them to engage in commercial sex acts.

Accordingly, the defendant committed commercial sex acts such as arranging commercial sex acts.

No person who violates the School Health Act shall conduct business in a school environmental sanitation and cleanup zone where the physical contact, such as mouths, pets, composts, and sediment, etc., is made, or sexual intercourse is likely to be made, by exposing sex-related physical parts, or similar act is likely to be done, after having been equipped with a smuggling, closed space or partitions, etc. and keeping bedclothes, beds, etc.;

Nevertheless, from the end of January 2014 to September 16, 2014, the Defendant installed a guest room equipped with simple beds and shower facilities in a space partitioned by walls at around 20 meters away from the school environmental sanitation and cleanup zone at the Namyang-si Elementary School located in approximately 20 meters away from the end of September 16, 2014, and operated a sex act as stipulated in paragraph (1).
