A Imprisonment of 3 years and 6 months and fine of 3,678,490,547 won, Defendant B shall be punished by imprisonment of 2 years and 6 months, Defendant C and D, respectively.
Reasons
Punishment of the crime
Changes shall be recognized to the extent that does not impede the defendants' exercise of their rights to defense.
Any person who intends to import goods shall file a report with the head of the relevant customs office on the name, standard, quantity and price of the relevant goods, and other matters prescribed by Presidential Decree.
1. Defendant D, Defendant C, and Defendant A’s joint crime committed by Defendant D, Defendant C, and Defendant C brought in the Republic of Korea from China to Korea, and conspired to distribute them to Korea.
On April 4, 2014, upon receipt of a request for the smuggling from Defendant D and Defendant C, Defendant A brought in the Republic of Korea the 12 gold bars (one kilogram per unit, 12 kilograms in total, 384,573,948 won per unit, and the market price of 583,572,00 won in total) taken from the name and non-explosive from the name and non-explosive port for China by using the above OF lines.

C. On April 4, 2014, Defendant D received 12 gold bars in front of the post office located in the Jung-gu Incheon Metropolitan City, Jungpo-dong, without reporting to the head of the customs office, and Defendant D received 12 gold bars imported from Defendant D around the same day, and Defendant D received 12 gold bars imported from Defendant D around the same day.
Accordingly, Defendant D, Defendant C, and Defendant A did not make a declaration in sequence to the customs collector, and they imported 12 gold bars (a total of 12 kilograms per kilogram, total of 384,573,948 won per unit, total of 384,573,948 won, market price of 583,572,00 won).

D. From that time to October 13, 2014, Defendant C, and Defendant A conspired in sequence and did not report to the head of the customs office from that time in the manner described above, and imported a total of 102 gold bars (one kilogram, a total of 1 kilograms per unit, 102 kilograms, a total of 3,121,384,452 won, a total of 3,121,384,452 won, and a total of 4,736,028,000 won), as listed in the list of crimes in the attached list of crimes.
2. The Defendants, as well as the Defendants, intend to import gold bars in P and China and distribute them to the Republic of Korea.
