1. The plaintiff's primary and conjunctive claims against the defendants are all dismissed.
2. The costs of lawsuit are assessed against the Plaintiff.
Reasons
1. Basic facts
A. The Plaintiff, around 191, newly constructed and sold a reinforced concrete structure slive roof, which is an aggregate building on the instant land, 166.64 square meters in general amusement restaurants G, 166.64 square meters in 167.06 square meters in 107.06 square meters in 1st floor, 108.09 square meters in 108.09 square meters in 2nd floor and 246.15 square meters in 2nd floor (hereinafter “instant aggregate building”), along with the portion of exclusive ownership of the instant aggregate building, with regard to some of the instant land shares.
As in the same paragraph, the registration of ownership transfer was completed, and the aggregate building of this case is currently purchased by sale in lots or before transfer for each part of the whole land, Defendant D has divided the underground G of the aggregate building of this case, Defendant C H of the first floor, Defendant B-I of the first floor, and Defendant E-I of the second floor.
B. After the completion of the registration of ownership transfer for the land of this case on March 17, 1990, as to the 65/372 shares among them on April 1, 1991, as to the 65/372 shares among them on April 1, 1991, as to the 65/372 shares among them, Defendant C in the future, as to the 40/372 shares among them on October 10, 1991, K in the future, as to the 66/372 shares among them, there was a completion of the registration of ownership transfer for the 66/372 shares among them on January 10, 196, as to the 66/372 shares, and as to the above shares, the registration of ownership transfer for the above shares was completed in the future of Defendant D through M on December 29, 203, and as to the above shares on August 31, 2001.
C. The entire land of this case is used as the lower land (land abutting on the floor) and the math, passage, etc., and thus, “site” generally within the scope necessary for the use of the instant aggregate building is a concept that includes the land that is strictly adjacent to the floor of the building, i.e., the land adjoining to the floor of the instant aggregate building, i.e., the land where the building is located, namely
(iii) [based on recognition] unsatisfy, entry and video of Gap 1, 2, 7, 9, 10 evidence, and Eul 3 evidence (including each number; hereinafter the same shall apply);
