『2012고단655-피고인 A』 피고인 A는 2012. 6. 5. 16:40경 통영시 E에 있는 F 3층에서 피해자 G(20세)과 서로 눈이 마주친 일로 피해자에게 “뭘 쳐다보냐. 나를 아냐. 1층에 가서 얘기 좀 하자.”고 말하여 피해자를 위 F 1층에 있는 H 편의점 앞으로 데리고 가 피해자와 말다툼을 하던 중 위 편의점 앞에 있는 쓰레기통을 잡고 피해자를 향해 휘두를 듯이 위협하고, 이에 피해자로부터 주먹으로 얼굴을 얻어맞자 피해자의 얼굴을 주먹으로 때리는 등 서로 주먹다짐을 하다가 흥분하여 위 편의점 안에 들어가 소주 2병을 들고 나와 왼손에 쥔 소주병을 벽에 쳐 깨뜨린 다음 위험한 물건인 깨진 소주병을 들고 피해자의 얼굴을 향해 2회 휘둘러 피해자의 오른쪽 귀 및 안면부위 등을 베었다.

가. 피해자 I에 대한 범행 피고인 A는 2012. 4. 9. 21:00경 통영시 J에 있는 ‘K식당’ 앞 보도에서 그곳을 걸어가는 피해자 I(18세)이 자신을 기분 나쁘게 쳐다본다는 이유로 식당 옆에 놓여 있던 위험한 물건인 유리로 된 빈 맥주병 1개를 들어 피해자의 머리 부위를 1회 힘껏 내리치고 위 식당 안으로 피해자가 도망가자 안으로 쫓아들어가 “개자슥아 나온나, 오늘 죽여 버린다”라고 말하며 양손으로 피해자의 멱살을 잡아 흔들어 피해자에게 약 2주간의 치료를 요하는 뇌진탕을 가하였다.

B.
