A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. On June 2015, the Defendant and C, along with C, conspiredd to create a passbook to the next in Daegu, Daegu, and sell it to D. On June 2015, the Defendant concluded that “I create a Tong to reduce KRW 200,000,000 if I created a Tong to the e and F at a mutual inficial restaurant located in the Daegu, Northern, Dongcheon-gu, Daegu, Incheon, and that “I am to create a Tong to the effect that I would create a Tong to the next inficial area.”
A. On June 2015, E’s receipt and transfer of the access medium in the name of E: (a) around 4, 2015, from E to 4, the Defendant opened a passbook of the National Bank of Korea (Account Number: G) and one cash card connected to the above passbook and one password; and (b) around that time, the Defendant received KRW 800,000 per head of the Tong at the Daegu Non-Kan area; (c) around that time, the Defendant added the above passbook and one cash card connected to the above passbook in the name of E and the password to D.
Accordingly, in collusion with C, the Defendant acquired and transferred the access media in the name of E.
B. On June 2015, the Defendant acquired the F’s access media and transferred the F, along with C, one passbook (Account Number: H) and one cash card connected to the above passbook from F (Transfer to Juvenile Department on December 14, 2015) in the vicinity of the lives of the National Bank in Daegu Northern-gu, Daegu, Daegu, at the same time, and 80,000 won per head of the Tong at the Daegu Non-U.S. on June 2015, and the Defendant added the above F’s passbook and one cash card and its password to D.
Accordingly, in collusion with C, the Defendant acquired and transferred F-name access media.
2. On July 2015, the Defendant alone committed the Defendant’s sole crime that reads “E in the vicinity of the intersection in the Daegu Northern-dong, Daegu-do, the head of the Tong” to mean “I bank passbook in the name of E from the vicinity of the said intersection at the end of July 2015, the head of the Tong (the account number: ..................... the head of the Tong-gu, the head of the Tong-gu, the head of the Tong-gu, the head of the Tong-gu, the head
