1. The plaintiff's claim is dismissed.

1. The Plaintiff asserted the cause of the instant claim. The Plaintiff asserts that, from January 30, 201 to December 27, 2011, a total of KRW 24,350,000 was set at 2% of the interest rate per month on January 31, 2012 (hereinafter “instant loan”), the Defendant is liable to pay the Plaintiff the amount of KRW 24,350,000 and delay damages.

According to each of the evidence Nos. 1 through 9, the plaintiff's transfer of 24,350,000 won to the defendant's ancillary account. However, considering the following circumstances acknowledged by the previous purport of the pleading, namely, that the plaintiff did not have the details of preparing a loan certificate or receiving interest from the defendant in relation to the loan of this case, and that the repayment period can be determined and claimed by the plaintiff at his own discretion, the above facts alone are insufficient to recognize the loan of this case, and there is no other evidence to acknowledge it.

2. The plaintiff's claim is dismissed as it is without merit.
