Reasons
1. Summary of the facts charged in this case
A. Defendant A is a person who operates the balring as the trade name of Q in P at the time of stay, and the J is a representative of the Livestock Construction Business Chain Co., Ltd. (hereinafter “L”) located in K at the time of harmony.
With the expansion of the opening of livestock products outside due to the free trade agreement (FTA) of the Government, the Ministry of Agriculture and Forestry decided to grant subsidies from the State 30% of the total facility construction cost to livestock farmers who attempt M as part of the measures to support livestock farmers. The Ministry of Agriculture and Forestry decided to grant subsidies from the State on the condition that livestock farmers will first bear 20% of the total facility construction cost. Defendant A applied for the selection of a subsidy project operator with respect to the above subsidy project in his/her name at the Office on February 15, 2011 and was selected as a subsidy project operator related to M on May 23, 201 (Seoulbukdo) (the total construction cost of KRW 273,870,000 in progress by Defendant A) on the condition that Defendant A would first bear 54,774,000 won in total in construction cost, and Defendant A would immediately pay the total construction cost of KRW 82,161,000 to the National Treasury of Korea with respect to the above subsidy project.
70 million won shall be sent.
In other words, the Court demanded “A” and even though it was aware that Defendant A would have attempted to manipulate the details of treasury subsidies to receive government subsidies, the J transferred KRW 70 million out of the company’s operating funds to Defendant A at around 16:38 of the same day in response to Defendant A’s request to receive the construction contract, and Defendant A transferred KRW 70 million to L account on the same day.

On February 27, 2012, A completed the self-payment of 64,107,80 won for stable facilities to public officials R in the distribution and office of resident viewing.
