All of the prosecutions of this case are dismissed.
Reasons
The Defendant, “2018 Highest 521” from October 31, 2016, is the actual manager of C(State) located in Jeonnam Ma-gun B, who ordinarily employs 42 workers and engages in the manufacturing of pharmaceutical products.
1. The Defendant in violation of the Labor Standards Act against employed workers did not pay KRW 2,00,00,000 for July 10, 2017, which was employed by the said workplace from September 10, 2012 to August 10, 2017, on a regular wage payment date. As indicated in attached Table 1, the Defendant did not pay KRW 78,916,678 for the total amount of wages of July 2017 for 43 employed workers, including KRW 80,813,446 for the total amount of wages of August 10, 2017, on a regular wage payment date.
2. The Defendants who violate the Labor Standards Act and the Guarantee of Workers' Retirement Benefits Act with respect to retired workers shall work in the relevant workplace from June 17, 2016 to July 10, 2017.
The retirement E’s wage of KRW 2,49,99,99 for July 2017 was not paid within 14 days from the date of the retirement without an agreement between the parties on the extension of the due date, as shown in the attached Table 2, and the retirement allowance of KRW 18,672,953 in total, the retirement allowance of KRW 3,220,664 in the above E, and KRW 77,910,068 in total, including the retirement allowance of KRW 77,910,068 in total, as described in the attached Table 3, was not paid within 14 days from the date of the retirement without an agreement on the extension of the due date between the parties.
The defendant is the representative director of the Co., Ltd. Co., Ltd. Co., Ltd. in Jeonnam-gun, and is an employer who runs the manufacturing business using 47 full-time workers.
1. The Defendant violating the Labor Standards Act is working in the above workplace from January 10, 203 to October 10, 2018.
The amount of wages of 3,416,666 won in September 2017 shall not be paid within 14 days from the date of retirement without an agreement between the parties on the extension of the due date, as well as the total amount of wages of 42,295,028 won and non-paid annual allowances, as shown in attached Table 4.
