Defendant shall be punished by a fine of KRW 1,500,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. 업무방해 피고인은 C과 공모하여 2014. 1. 12. 22:30경 성남시 중원구 D에 있는 피해자 E(여, 23세)이 관리하는 F 편의점에서 피고인과 C은 술에 취하여 서로 실랑이를 하며, 위 편의점에 진열된 물건을 떨어뜨리고, 피고인은 피해자에게 “몇 살이냐, 살쪘다, 귀엽다.”고 말하면서 피해자가 서 있는 계산대 앞을 반복하여 오가고, C은 비틀거리며 편의점 진열대 사이를 반복하여 오가고, 피고인은 편의점 내부에서 담배를 피우고, 피해자가 피고인에게 편의점 내부에서는 흡연을 할 수 없다고 하며, 밖으로 나가 줄 것을 요구함에도 담배를 계속하여 피우며, C과 편의점 내부에서 술을 마시고, 이에 피해자가 편의점 밖으로 나가 줄 것을 요구함에도 계속하여 담배를 피우고 술을 마시며 시끄럽게 떠들고, 편의점에 있던 다른 손님들의 신고로 출동한 경찰관이 편의점 내부에서 술을 마시고, 담배를 피우면 안 되니 나가달라고 요청함에도 출동한 경찰관들에게 욕설을 하는 등 약 20분 간 위력으로 피해자의 편의점 영업 업무를 방해하였다.

Accordingly, the defendant conspireds with C to interfere with the convenience store business of the victim by force.
