Reasons
Punishment of the crime
1. At around 04:00 on February 9, 2014, Defendant C’s sole criminal conduct stolen the victim’s neck, which was located in the above EBA club, with the victim’s Franshing the floor, and 300,000 won in cash, and credit cards, etc. that were located therein.
2. The Defendants’ co-principal Defendant C stolen the wall as referred to in the preceding paragraph, and displayed the above wallets to Defendant A and B, and the Defendants were willing to purchase goods with a stolen credit card on the above wall.
On February 9, 2014, around 04:31, 2014, the Specialized Credit Financial Business Act violation, the fraud C, and A entered the "I convenience store operated by the victim H in Bupyeong-gu, Nowon-gu, Seoul", and made tobacco 1. A, and then, for the payment of the price, the victim suggested that the victim was a legitimate licensee of the above credit card and made a stolen credit card and used the stolen credit card by the defendants, as in the preceding paragraph, as the victim suggested that the victim was the legitimate licensee of the above credit card, and the victim used the stolen credit card, and the defendant B was waiting for the network outside the above convenience store.

B. Defendant C and A attempted to commit fraud: (a) around 04:20 on February 9, 2014 (the “204:31” stated in the indictment appears to be a simple clerical error); (b) enter the “K convenience store operated by the Victim JJ in Nowon-gu, Nowon-gu, Seoul; and (c) present one copy of the national card that stolen as stated in the preceding paragraph to pay the price to the victim as if the said credit card was the legitimate licensee of the said credit card; (d) however, the victim refused to pay the said credit card with the theft reported and thus, (e) wanting to obtain a claim against the victim in the market value.
