A defendant shall be punished by imprisonment for six months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On May 8, 2013, the Defendant: (a) around 21:00 on May 21, 2013, the victim C (the 45-year-old) operated the victim and his employees set up a string line, opened a string line with a card held by the Defendant in advance, and intruded and displayed in the store, the Defendant stolen 53,650 won in total at the market price of the victim’s possession of 39,00 won (the 1950 won per opening) and 4,750 won in the market price.
2. From around 19:40 on May 19, 2013 to around 21:00, the Defendant stolen the Defendant’s share of KRW 112,90,00, total market price of 100,000, which is the victim’s own market price owned by the victim and his employees and displayed in a store by the same method as those set forth in the foregoing D, which was invaded and displayed within the same period of time as the victim’s and employees set aside.
3. 피고인은 E(같은 날 기소유예)와 합동하여, 2013. 6. 6. 20:40경 위 D 마트 내에서 피해자 및 종업원들이 퇴근을 한 사이 같은 방법으로 침입하여 매장 내 진열되어 있던 피해자 소유의 시가 18,000원 상당의 머스터 소스 6개(개당 3,000원), 시가 18,800원 상당의 오이피클 4캔(1캔 4,700원), 시가 34,500원 상당의 두루마리 화장지 3개(개당11,500원), 시가 20,000원 상당의 사리곰탕 컵라면 1박스, 시가 19,500원 상당의 튀김우동 컵라면 1박스, 시가 28,500원 상당의 맥주 피처 6개(개당4,750원), 시가 51,000원 상당의 음료수 3박스(1박스 당 4,750원), 시가 20,000원 상당의 과자 20봉지, 시가 45,000원 상당의 욕실 용품 5가지, 시가 50,000원 상당의 식기 세척기 세제 2통(1통 25,000원), 시가 50,000원 상당의 식시 세척기 린스 2통(1통 25,000원), 시가 17,700원 상당의 퐁퐁 3통(개당 5,900원) 등 시가 합계...
